We received an appointment from a building owner to deal with the party wall matters under the Party Wall etc. Act 1996. The building owner is proposing to undertake major works to a 300 year old listed property. These works include the demolition of a modern extension replacing it with a new three-storey structure. The new extension will include the reconstruction of the basement area which includes excavations.
The property is adjacent to an underground reservoir belonging to a water company. As required under the Party Wall etc Act 1996 party wall notices were served on the water company. The water company have appointed a surveyor to deal with matters in accordance with the party wall procedures.
Our appointing owner has rights to undertake the works. The proximity of the reservoir means that the party wall legislation applies.
In accordance with party wall legislation we will prepare a schedule of condition of the accessible areas of the reservoir. We will record details of the reservoir to include its nature and condition which will form a schedule of condition. The party wall award will include the schedule of condition along with details of the the proposed works. The award will include where appropriate method statements and risk assessments for works deemed sensitive which may cause damage.
