The Landlord of a car showroom and garage instructed us to prepare a dilapidations claim against the outgoing tenant. The Lease had two months left to run. Schedules of Dilapidations should be served before the Lease end, especially if reinstatement is required.
The tenant had been in occupation for a number of years and had poorly maintained the buildings and site. The buildings were of basic construction. The demise included a car showroom to the front of the site with vehicle workshops to the rear. The site included areas of parking and hard standing around the buildings and a field to the rear.
We reviewed the Lease, undertook an inspection and prepared and a Schedule of Dilapidations. This schedule set out the items of reinstatement, repair and redecoration forming the claim. We also included elements of claim relating to statutory compliance and environmental issues.
We priced the elements in the Schedule of Dilapidations for negotiation purposes. Once we completed the Schedule of Dilapidations we issued it to the Landlord for formal service on the tenant.
