Our Client was taking an assignment of a Lease in Redhill, Surrey. The Lease was for the ground floor premises in a multi-let building. The proposed demise was currently operating as a restaurant and takeaway.
In taking the demise our Client wanted to understand his potential liabilities. Our Client instructed us to undertake an inspection and prepare a building survey report.
We reviewed the Lease to determine the extent of the demise and its terms. This allowed us to identify the potential liabilities the Client may face. We undertook an inspection of the property which confirmed the demise was in modest condition. We highlighted a number of issues to our Client. These issues included defects with the structure and fabric along with elements of non compliance.
The demise included a basement which was in a poor condition and currently used for storage. The Client was considering using the basement for other purposes, including providing living accommodation. We advised that in its current form the space was not suitable for such use. Significant works would be required to create living accommodation in the basement, which in our opinion was not viable.
Our report provided clear advice to allow our Client to progress their negotiations understanding the issues and implications of the purchase.
