We received instructions to undertake an inspection of a period building in Chichester from our Client. Our Client was looking to take the lease of a retail unit in Chichester and was concerned about its condition.
Our instructions included to undertake a building survey to report on the nature and condition of the period building. This was to ensure that our Client had a clear understanding of the issues they would become liable for. Our Client also instructed us to prepare a Schedule of Condition of the property.
Our Client agreed with the Landlord to attach a Schedule of Condition to the Lease and limit their lease liabilities. This was to limit the repairing obligations and not being liable for existing defects recorded in the Schedule of Condition. The building is in a poor condition with a number of defects evident. This included age related issues and movement to include uneven roofs and floors. The Schedule of Condition would ensure that our Client was not responsible for any pre-existing defects or age related movement.
The Building Survey Report and Schedule of Condition were issued and discussed with our Client.
